Please read these Terms of Service ("Terms") carefully before using FastCompete's price monitoring platform and related services (the "Service") operated by FastCompete ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
By creating an account, clicking "I agree", or otherwise accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy.
If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and references to "you" include that organization.
FastCompete provides a price intelligence and monitoring platform that enables e-commerce businesses to track competitor pricing, monitor minimum advertised price (MAP) compliance, and implement dynamic pricing strategies.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
You must notify us immediately of any unauthorized use of your account by contacting us.
You may not share your account with others or create accounts by automated means.
You agree not to use the Service to violate any applicable law or regulation.
You agree not to infringe the intellectual property rights of any third party.
You agree not to transmit any harmful, offensive, or disruptive content.
You agree not to reverse-engineer, decompile, or attempt to extract source code from the Service.
You agree not to resell, sublicense, or redistribute access to the Service without our written consent.
You agree not to use the Service to build a competing product or service.
You agree not to circumvent any rate limits, access controls, or security measures.
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share information about you. By using the Service, you agree to the collection and use of information as described therein.
The pricing and product data collected through the Service is used solely to provide you with competitive intelligence. We do not sell your proprietary business data to third parties.
We may also use third-party analytics and advertising tools, including Google Analytics and Google Ads, to understand how visitors interact with our website and to reach potential customers through targeted marketing. These tools may collect information such as your IP address, browser type, and pages visited. You can opt out of Google Analytics tracking via the Google Analytics Opt-out Browser Add-on.
Paid plans are billed on a subscription basis (monthly or annually). By providing payment information, you authorize us to charge the applicable fees to your payment method.
Subscription fees are non-refundable except as required by law.
We may change our pricing with 30 days' written notice. Continued use after the notice period constitutes acceptance.
If your payment fails, we may suspend your account until payment is resolved.
The Service and all content, features, and functionality thereof — including but not limited to software, text, graphics, logos, and data — are owned by FastCompete and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms. No other rights are granted.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that pricing data will be complete, accurate, or up to date. Competitive pricing information is gathered from publicly available sources and may not reflect real-time market conditions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTCOMPETE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Pricing data accuracy may also be affected by external factors outside our control, including but not limited to changes in competitor website structure, temporary or permanent unavailability of third-party websites, and anti-scraping measures. We make continuous efforts to detect and address data anomalies; however, we cannot guarantee the accuracy of information impacted by such external factors.
Our total cumulative liability for any claims arising under or related to these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
You may terminate your account in accordance with your agreement by contacting us or through your account settings. We may suspend or terminate your access to the Service in accordance with your agreement, with or without cause, with or without notice.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination — including ownership, warranty disclaimers, and limitations of liability — shall survive.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service prior to the changes taking effect.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
